1. Eligibility And Accounts
These Terms of Service ("Terms") govern access to and use of Kaboosh websites, apps, APIs, games, subscriptions, and related services (the "Service"). The Service is operated by Kaboosh Education Ltd.
By using the Service, you agree to these Terms and to our Privacy Policy. If you use Kaboosh for a school, district, company, or other organization, you confirm that you are authorized to accept these Terms for that organization.
- Users under 18 should use the Service only with parent, guardian, school, or teacher approval.
- Children under 13 in the United States, or under the local age of digital consent elsewhere, may use direct accounts only with required consent.
- Institutions are responsible for obtaining required notices, consents, and permissions for their users.
- You must provide accurate account information, keep credentials secure, and promptly tell us about unauthorized access.
2. The Service
Kaboosh provides learning tools including flashcards, decks, assignments, classroom workflows, learning games, spaced repetition, progress reports, public decks, image search, translation, text-to-speech, speech recognition, pronunciation feedback, OCR, writing feedback, and AI-assisted study features.
We may add, change, limit, or remove features. Free, trial, paid, school, and enterprise plans may have different limits.
3. Acceptable Use
You may not:
- upload, create, or share unlawful, abusive, harassing, hateful, pornographic, violent, exploitative, bullying, self-harm, eating-disorder, or otherwise unsafe content;
- upload child sexual abuse material or any sexualized content involving minors;
- share private personal data without permission;
- infringe copyright, trademark, privacy, publicity, or other rights;
- spam, scrape, crawl, overload, disrupt, reverse engineer, or bypass security controls;
- use bots or automation except through documented APIs or approved integrations;
- access paid features without authorization or evade plan limits;
- use the Service to build or train a competing product without written permission; or
- misuse AI features to generate harmful, deceptive, discriminatory, infringing, or unlawful material.
4. Child Safety, Reporting, And Moderation
Users can report public decks or other available community content through in-product reporting tools or support channels. We may use automated moderation tools and human review to detect unsafe content. Where appropriate and safe, we may notify affected users of moderation decisions and provide an opportunity to appeal.
For UK or EU users, these reporting and moderation processes are intended to support clear reporting, complaint handling, and content moderation transparency where those rules apply.
5. User Content
"User Content" means content you upload, create, import, publish, or submit through the Service, including decks, flashcards, text, images, audio, notes, ratings, reviews, and comments.
You grant Kaboosh a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, display, transmit, and distribute User Content only as needed to provide, secure, support, and improve the Service. This includes making public decks visible when you choose to publish them and processing content through translation, text-to-speech, speech recognition, OCR, moderation, or AI features you use.
You are responsible for having the rights needed to upload and share your User Content.
6. Public Decks And Community Features
If you publish a deck or profile element publicly, other users may view, copy, rate, review, or report it depending on the feature. You can make public content private where the product allows, but copies already made by other users may remain in their accounts.
Public content must follow these Terms and the Community Guidelines. Rights holders can report alleged copyright or trademark infringement through support. We may remove or restrict disputed content and may suspend repeat infringers where appropriate.
7. Intellectual Property
Kaboosh and its licensors own the Service, software, designs, logos, documentation, and other platform materials. Except for the limited right to use the Service under these Terms, no rights are transferred to you.
You may not copy, resell, sublicense, reverse engineer, or create derivative works from the Service unless allowed by law or by written permission.
8. AI, Speech, Translation, And Generated Content
AI, speech, translation, pronunciation, OCR, image search, and moderation features may produce incorrect, incomplete, biased, or inappropriate outputs. You are responsible for reviewing outputs before relying on them, especially for classroom, safety, legal, medical, or financial use.
You must not use these features to generate or process unlawful, unsafe, infringing, discriminatory, deceptive, or privacy-invasive content.
We do not permit third-party AI providers to train their general models on identifiable student or child content unless the relevant parent, user, or institution explicitly authorizes it and applicable law allows it.
9. Third-Party Services
Examples may include Supabase, Cloudflare, Netlify, Stripe, Sentry, OpenAI, Google, Google Vertex/Gemini, Azure, Deepgram, iFlytek, Hugging Face, Pixabay, Openverse, Pexels, Klipy, Serper, and similar providers.
Third-party services may have their own terms and policies. We are not responsible for third-party services outside our control.
10. Subscriptions, Trials, And Payments
By subscribing, you authorize us and Stripe to charge applicable fees, taxes, and recurring payments.
- You can cancel through account settings where available.
- Cancellation usually takes effect at the end of the current billing period.
- Trials, discounts, credits, and promotions may have additional conditions.
- Plan limits may be enforced in the client, server, or both.
- Prices, features, and limits may change with reasonable notice for material changes.
Refunds are handled according to the plan terms, applicable law, and any separate school or enterprise agreement.
11. Schools And Institutions
Where an institution manages accounts, Kaboosh processes institution-managed student data to provide the Service and follow the institution's instructions, applicable contracts, and applicable law.
Institutions are responsible for:
- ensuring they have authority to use the Service with students;
- providing required notices and obtaining required consents;
- configuring accounts and access appropriately; and
- responding to student and parent education-record requests, with our assistance where needed.
12. Privacy
Your use of the Service is also governed by the Privacy Policy and Cookie Policy.
13. Service Availability
The Service may be unavailable due to maintenance, outages, provider failures, security issues, network problems, legal requirements, or events outside our control.
14. Termination
After termination, your right to use the Service ends. Certain terms continue to apply, including ownership, payment obligations, disclaimers, limitations of liability, indemnities, and dispute provisions.
15. Disclaimers
To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and error-free operation.
16. Limitation Of Liability
To the fullest extent permitted by law, Kaboosh and its affiliates, officers, employees, contractors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business interruption.
Our total liability for claims relating to the Service will not exceed the greater of the amount you paid Kaboosh for the Service in the 12 months before the claim or GBP 50. Some jurisdictions do not allow certain limitations. In those places, liability is limited to the minimum extent permitted by law.
17. Indemnity
This does not apply to the extent caused by Kaboosh's own unlawful conduct, gross negligence, or willful misconduct.
18. Governing Law And Disputes
Please contact us first so we can try to resolve disputes informally. Nothing in these Terms limits statutory rights, consumer rights, data-protection rights, or rights that cannot be waived by contract.

20. App Stores, Export, And Sanctions
If you install Kaboosh through an app store, that store's terms may also apply. You may not use the Service where prohibited.
21. Changes To These Terms
We will provide notice of material changes where practical or required. Continued use after changes take effect means you accept the updated Terms.
