Affiliate Program Terms & Conditions

0. Overview & Relationship
Kaboosh Education Ltd. (“Kaboosh”, “we”, “our”, or “us”) offers an affiliate program that rewards approved partners (“Affiliates”, “you”) for referring new paying customers to the Kaboosh platform. These Affiliate Program Terms & Conditions (“Affiliate Terms”) apply in addition to our main Terms of Service and Privacy Policy and govern your participation in the program.
By joining or continuing to participate in the Kaboosh affiliate program, you agree to these Affiliate Terms, our main Terms of Service, and all applicable laws in your region.
1. Eligibility & Enrollment
- You must be at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into contracts.
- You must submit accurate information during signup, including your legal name, contact information, and (where required) tax or payment details.
- We reserve the right to approve, reject, or suspend any affiliate account in our sole discretion, for example where a site or audience is not aligned with our brand or legal obligations.
- You are responsible for keeping your account details (including payout information) up to date.
2. Independent Contractor Status
Your participation in the affiliate program is as an independent contractor. Nothing in these Affiliate Terms creates an employment relationship, partnership, franchise, or joint venture between you and Kaboosh. You may not represent that you are a Kaboosh employee or speak on behalf of Kaboosh unless we have given you written permission.
You are responsible for your own business operations, including taxes, licenses, insurance, and compliance with advertising/marketing laws.
3. Affiliate Links, Cookies & Attribution
- You will receive one or more unique affiliate links or codes to promote Kaboosh. You must use these to ensure we can attribute referrals to you.
- Attribution uses URL parameters, cookies or similar storage, and internal referral IDs. Where more than one eligible affiliate link is used, the most recent valid attribution applies. If a user blocks or clears tracking data or signs up on a different device, attribution may not occur.
- We aim to track referrals fairly and accurately but cannot guarantee tracking in every scenario. We are not liable for commissions that cannot be credited due to technical limitations, ad‑blockers, or user privacy controls.
- The 12-month attribution window applies between the affiliate click and the customer’s first subscription. Once a qualifying subscription is attributed, eligible renewal commissions continue for the lifetime of that active subscription.

4. Commissions, Payouts & Taxes
- Unless we agree a custom rate with you in writing, the standard ladder is: Starter (0–19 active paying referrals) earns 25% lifetime and 35% on the first paid invoice; Growing (20–99) earns 30% and 40%; Established (100–499) earns 35% and 45%; and Pro (500+) earns 40% and 45%.
- Commissions are calculated on the subscription amount actually paid after coupons and discounts and excluding tax. Payment-processing fees are not deducted from the commission base. Refunded, disputed, voided, or unpaid amounts are not eligible.
- Monthly commissions are approved 14 days after payment and annual commissions 21 days after payment. Approved commissions become payout-eligible on a NET30 schedule after approval. The minimum payout is the US$50 equivalent per partner; smaller balances roll over.
- Payouts are made manually by bank transfer or PayPal. A commission is marked paid only after Kaboosh confirms the external transfer completed successfully.
- If a payment is later refunded, disputed, voided, or found to be fraudulent, the corresponding commission may be reversed or deducted from future payouts. You remain responsible for taxes, reporting obligations, and receiving-bank or PayPal fees related to your earnings.
5. Permitted Promotion & Brand Use
- You may promote Kaboosh via your websites, newsletters, social media, podcasts, events, or other channels you legitimately control.
- You must comply with advertising laws and industry rules, including disclosure requirements (for example, clearly stating that links are affiliate links or that you may receive a commission).
- You may use Kaboosh brand assets provided in the affiliate resources, but you may not modify logos or suggest official endorsement beyond what we state in writing.
6. Prohibited Conduct
- You may not engage in deceptive, misleading, or manipulative practices, including false claims about Kaboosh features, pricing, or outcomes.
- You may not promote Kaboosh on sites or channels that contain hate speech, harassment, adult content, illegal activities, or content that would reasonably harm our reputation.
- You may not send unsolicited bulk emails (spam) or use purchased lists. All email marketing must comply with anti‑spam laws in your jurisdiction (e.g., CAN‑SPAM, CASL, GDPR) and include proper opt‑out mechanisms.
- Unless we explicitly permit it in writing, you may not bid on Kaboosh trademarks or domain names (e.g., “Kaboosh”, “Kaboosh app”) in paid search advertising or register confusingly similar domains.
- You may not create fake accounts, self‑refer for personal discounts, or attempt to bypass our pricing, trials, or geographic restrictions.
7. Data Protection & Privacy
Kaboosh processes personal data in line with our main Privacy Policy. As an affiliate, you may also collect or process personal data about your audience (for example, via your own website, mailing list, or analytics tools). You are independently responsible for complying with applicable privacy and marketing laws when you do so.
You must not share with us any personal data about your audience unless we have expressly agreed in writing and have appropriate data‑protection terms in place.
8. Term, Suspension & Termination
- These Affiliate Terms apply from the date you are accepted into the program until terminated by you or us.
- You may terminate your participation at any time by contacting support or closing your account.
- We may suspend or terminate your affiliate account immediately if we believe you have violated these Affiliate Terms, applicable law, or engaged in fraud, abuse, or behavior that could harm Kaboosh or its users.
- Upon termination, you must stop using affiliate links and brand assets. We may withhold unpaid commissions that are reasonably associated with suspected fraud or serious violations.
9. Disclaimers, Liability & Changes
We do not guarantee that the affiliate program, tracking, or payout systems will be error‑free or available at all times. To the maximum extent permitted by law, Kaboosh will not be liable for indirect, incidental, or consequential damages arising out of or relating to the affiliate program.
We may update these Affiliate Terms or modify, pause, or discontinue the affiliate program at any time. Where required by law, we will provide notice (for example, by email or in‑dashboard announcements) and, if necessary, seek your consent to material changes.
10. Governing Law & Contact
